, I find my sympathies more with OpenAI and Microsoft than with the NYT. The suit:

They are hosting the files as well. The text interface is like a search engine so there's precedent there. Furthermore, Safe Harbor provisions don't even apply in this case because MJ is selling the outputs — and couldn't comply with the rest of the DMCA even if they wanted to.
