I've seen many times where incentive misalignments create enormous problems, regardless of how much effort is spent on communicating the vision. So I don't agree its fine as long as everybody knows what they're signing on to.

Both OpenAI (through "Profit Participation Units") and Anthropic offer compensation that's primarily based on profitability. Yet OpenAI is run by a non-profit and Anthropic is a PBC. This means that staff incentives are by definition not aligned with the companies' missions.

Yes that's fair – although if I were a board member I wouldn't go against the company charter in the hope that a court might later decide it was actually OK to do so. In fact I wouldn't join a board where I disagreed with the charter.
