In the Anthropic case, the mere downloading & storage (i.e. reproduction) of a pirate work was infringing and not Fair Use. There is no derivative required, nor does it need to be published, nor sold to a buyer. The defendants need to prove absence of market harm either way!

Fair Use and Copyright Infringement in Generative AI Legal Cases
By

You're struggling! There is no second infringement required to justify the non-fair use of the first infringement. As per Dr. Seuss v. ComicMix, the burden of proof is on the defendants to show absence of market harms — not other way around. Grounds for appeal maybe…

Copyright and Data Protection in AI Training

1) Reductio ad absurdum fallacy. Copyright doesn't protect bytes, electricity. 2) There are protected expressions in there that are valuable and sold as data. 3) There is infringement simply reproducing the work before training.

Consent Foundations Commerce Creativity AI Prototypes

Reddit Lawsuit Against AI Companies Over Terms of Service Compliance
By

This will probably get settled; Reddit just suing to increase the pressure? The AI companies, including Anthropic, don't want to set a new precedent that they must respect Terms of Service… Prior claims (e.g. Genius v Google) were deemed to be preempted by © law and dismissed.

Public Square Networks Sustainability and Cultural Splits

I think the culture there reflects the split that occurred, likewise the culture here. I bet Twitter is not growing either, so I'm not sure any such "public square" network is really sustainable anymore (regardless of the brand).

Government Negligence Shifts Tax Blame to Tech Companies
By
–
Just because ministers in the cabinet are negligent doesn't mean that it'll be voted for as a tax. The opposite in fact, to cover their ass they'll put the blame on the companies. This whole thread is entirely bad faith arguments. I'm done here!

Government Liability vs Tech Innovation Responsibility

In this case, if the *government* is negligent or liable (not Tech Bros) that changes everything.
