I don't rule out the AI lobby getting its way (and indirectly abolishing copyright), but I don't think the current law reads that way. It would be a major change to international law.

Well, that's a false analogy. MPEG codec is software not data; if you encode Copyrighted data then the output is derivative and potentially infringing. Plus the expressions that earn copyright don't require exact data, quite the contrary.

Transformative will always be subjective, you can't just claim it; the moment a company relies on Fair Use, they leave themselves open to a claim that only a judge can resolve. (Plus under international © law, lawsuits can occur abroad.) Seems like bad business either way…

Loving how you talk about this in the past tense! You know it's going to court for the remaining claim, right? The Books case was at least matched by AWF v. Goldsmith and the archive(.)org cases on Fair Use, and those are the most recent — not as settled as you'd hope!
