Or processing books to count word frequency statistics, that's a valid Text & Data-Mining exception. It's very different than learning to regenerate the same book word-by-word!

AI Community Deserves Options: Pause or Continue Debate
By
–
It needs to be answered with the same amount of publicity. PAUSE or CONTINUE? THE AI COMMUNITY DESERVES OPTIONS. The Future of Life Institute Open Letter only offers 1 option (Pause). The new @Montreal_AI
Open Letter presents the missing choice (Continue) to humanity. Pause -

Fair Use for AI: International Legal Framework Development
By
–
This is the key part of the thread. They're trying to make a Fair Use clause for AI and not sure how to do it. They'll likely end up with something similar to UK/DE/EU — and also ensuring it's Berne compatible.

Japan AI Data Mining Copyright Compliance Berne Convention
By
–
This is limited to non-expressive data-mining, or "information analysis" as they call it. If they approximate the image or reproduce Copyrighted expressions, then Japan is bound to the Berne Convention like any other country.

Fair Use Training Contaminates Entire AI Applications with Legal Risk
By
–
TL:DR; You can't go from RED to ORANGE. Any component trained under Fair Use remains RED until you retrain. It will contaminate all the other parts of your application too, so even if the rest is GREEN you're still liable for the worst case RED bit!

Fair Use as Lifecycle Assumption in AI Applications
By
–
If you disagree, don't look at me. I don't decide and I don't care if you get sued 😉 Just trying to explain that Fair Use is not a single moment in time it's a set of assumptions you take on during the whole application's lifecycle.

Fair Use Licenses for AI Models: New Framework Emerging

I need to make a proper page for this, but it's a good start here: https://

… Where it's heading? I think there'll be licenses that make these conditions more clear. "The model was trained under Fair Use with this data, so you must respect those conditions." -
Licenses Cannot Waive AI Model Training Regulatory Requirements
By
–
How does that work? There is no license that can waive regulatory requirements, so if model training relied on those they continue to be applicable. (Fair Use and TDM are granted conditionally based on the application, so the conditions must carry through by definition.)

Fair Use Training Data Liability in Commercial AI Applications
By
–
Remember, models that rely on "Fair Use" or "Text & Data-Mining" exceptions, those conditions carry through to the commercial application. Specifically, if you compete with the rightsholders whose data was used in training or harm their legitimate interests, you're still liable.

Parked Vehicles vs Robocars: Key Behavioral Differences
By
–
A personned vehicle stopped on Gough St is not 100% equivalent. They are subject to social shaming, they often respond to horns being blown, police can move them on. They intend to move soon. They are not waiting for rescue. The opposite of all these are true for robocars.
