You noticed that Musk fell from grace over Twitter and Ukraine. Is it obvious that the judge from Biden’s homestate who starts her verdict with the question whether the world richest man got overpaid did not make a political decision? Why not wait for arguments in the appeals?

By default you don't have the right to make derivatives (like in training), so in the meantime it can be assumed to be infringement.

Transformative is just one aspect of the criteria used to assess Fair Use. Fair Use is assessed on a case-by-case basis and there are no general rules or "laws" — otherwise it'd violate international Copyright conventions where exceptions must be limited by definition.

There is copying at training time, as per the claims going to court. If the system allows further downstream infringement, Fair Use would not absolve them of joint or secondary liability. Your understanding of the situation is not grounded in caselaw.
