OK, challenge accepted! I don't think greed (as pictured) is the main driver for people who stand to benefit from AGI. As a class, they have all the money they want. What they want is the next form of power: governments are decaying, and they need to control what's next…

AI Lobby and Copyright Law: International Legal Implications
By
–
I don't rule out the AI lobby getting its way (and indirectly abolishing copyright), but I don't think the current law reads that way. It would be a major change to international law.

Copyright implications of MPEG codec encoding derivative works
By
–
Well, that's a false analogy. MPEG codec is software not data; if you encode Copyrighted data then the output is derivative and potentially infringing. Plus the expressions that earn copyright don't require exact data, quite the contrary.

Large Models Approximate Input Aspects Through Examples

But no argument is needed to counter that falsifiable claim, just examples to show what you say is not true. Large models approximate many aspects of their inputs: https://

Generative vs Memorizing Circuits in AI Models
By
–
Well, that's not a fact that's just another argument. A counter-argument would be the paper about "generative circuits" and "memorizing circuits" and how models can include both.

Fair Use and Copyright Risks in AI Company Strategy
By
–
Transformative will always be subjective, you can't just claim it; the moment a company relies on Fair Use, they leave themselves open to a claim that only a judge can resolve. (Plus under international © law, lawsuits can occur abroad.) Seems like bad business either way…

AI Copyright Cases: Books, Goldsmith, Archive.org Fair Use Disputes
By
–
Loving how you talk about this in the past tense! You know it's going to court for the remaining claim, right? The Books case was at least matched by AWF v. Goldsmith and the archive(.)org cases on Fair Use, and those are the most recent — not as settled as you'd hope!

US Legal Framework Gap: AI Models as Creative Adaptations
By
–
There is a case to be made that models fall under database law where these laws exist (which has benefits), but the U.S. is stuck without — and thus the judge has no framework to reason about models as "Adaptations" like you'd think of a Film from a Book or an Album from a Play.

Kadrey v. Meta: AI Training Data Infringement Case in Court
By

The Kadrey (and Silverman) case v. Meta is still going to court for infringement at training time. Big Tech lawyers want to take this on! Coverage is terrible because this law firm seems to be throwing the cases; couldn't do much worse if they tried… https://

Fair Use Legal Framework: Four Factors in AI Copyright Cases
By
–
You know the case is going to court for the remaining claim, right? Plus there is no such thing as Transformative Use: Fair Use has four factors only one of which is transformation. If you can link to those mathematical facts it could help everyone!
