There's value to that argument, but this case is not about Copyright exceptions, rather a contract that's established through Terms Of Service. The relevant argument is that you can't sign a contract for unspecified / future uses under Copyright.

The reason Class Action lawsuits will soon be underway against Adobe? They're playing with words, then legal gaslighting users on the contradiction: "We don't train on your content in this case, but in this other place we can." I don't see Firefly coming out of this legitimate.

I'm surprised at the scale of the response too. But I think the response on this topic goes hand in hand with a greater awakening to the situation we find ourselves in as a society, almost to our surprise how things developed while we got complacent.

All we're seeing here are social issues, even if they are social issues about use of technology. It's not been about the technology. I agree though, people who call her "Not an artist." are equally misguided…
