The Code of Hammurabi comes in at 4500 words. Pretty long. But the new White House order on Artificial Intelligence comes in at 20,000 words. So at least it has accomplished the feat of being over 4 times larger than the Code of Hammurabi. Congrats to all who worked on this! But

IMO your points apply to non-open-source AI as well at 100x the scale (as proprietary AI is deployed massively) and open-source is the only way to keep non-open-source in check. Without it, you'll have extreme concentration of power/knowledge/secrecy with 1,000x the risk.
