they are at least using Bing chat, which uses OpenAI's GPT-4; i'm not sure how the ToU shakes out for that kind of usage (i'm not sure if you'd be following Microsoft's rules or OpenAI's rules, etc)

at first i was just thinking about it from a disclosure standpoint (like, are there levels of use of these tools that would be ok/not okay with me without disclosing it to readers?), but the more i thought about it the more issues came to mind.

like, do news organizations want to feed copy into these chatbots that's then used for training to improve the chatbots? (the new ChatGPT setting will let you avoid this, but afaik Bing chat doesn't offer that at the moment?) some might say yes, others might say no.
